ANJANA MISHRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 31.3.2014 in Akorhigola P.S. Case No.41/14 for the offence under Section 302/34 of the I.P.C.

It is submitted on behalf of the petitioner that he has been wrongly roped in the present case and there is no material either direct or indirect in the case diary. It is submitted that the petitioner has not been named in the F.I.R. and it was only during course of investigation that some of the witnesses made allegation that the petitioner was also responsible for the same, as there had been a quarrel between the deceased and the petitioner some time back.

No.40111 of 2014 (3) dt.14-01-2015 2/2 Considering the aforementioned submissions and also the petitioner has got no criminal antecedent and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Dehri, Rohtas, in Akorhigola P.S.Case No.41/14.
