In this case, the petitioner is seeking relief that Navsrijit Primary School, Makhanahi Pokhar, Jatahi (Baniya Tola) be upgraded as Middle School on the plea that the

Patna High Court CWJC No.17484 of 2019 dt.27-08-2019 2/3 Government has taken a policy decision to establish the Middle Schools in the radius of 2 Kms.

Earlier, the petitioner had approached this Court for the identical relief in C.W.J.C. No. 4676 of 2012 and this Court vide order dated 20.03.2012 directed the respondent no.2 to dispose of the representation of the petitioner in accordance with law as expeditiously as possible. Accordingly, the petitioner brought to the notice of the order of this Court to the Director, Primary Education, Bihar, Patna. In pursuance thereof, during the pendency of M.J.C. No.2113 of 2017, order vide memo no.1281 dated 25.09.2018 has been passed by the Director, Primary Education, in which he has directed the District Magistrate as well as the District Education Officer to take action for up-gradation of Navsrijit Primary School, Makhanahi Pokhar, Jatahi (Baniya Tola) to Middle School. Learned counsel for the petitioner submits that in pursuance of the aforesaid order of the Director, Primary Education, the petitioner has filed a representation to the District Magistrate, Madhubani, on 15.10.2018 for upgrading the said School, but till date no positive step has been taken by the District Magistrate.

With the aforesaid observations and directions, this writ petition is disposed of.
