2. The petitioner seeks regular bail in connection with Special Excise Case No. 9144/2022, arising out of Phulwari Sharif (Janipur) P.S. Case No. 1613 of 2022, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per prosecution, 100 litres of country made liquor has been recovered from the tempoo.

4. Learned counsel for the petitioner submits that the petitioner is innocent no incriminating material has been recovered from the possession of the petitioner and he is in custody since 28.05.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, Excise, Patna in connection with Special Excise Case No. 9144/2022, arising out of Phulwari Sharif (Janipur) P.S. Case No. 1613 of 2022.
