This is an application for bail in connection with Muffasil P.S. Case No. 87 of 2017 registered for the offences punishable under Section 30(A) of Bihar Excise Act.

Allegation against the petitioner is of recovery of 240 litres of liquor from his possession.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he is in custody since 14.7..2017 having no criminal antecedent.

Having heard both sides and in view of facts and circumstances, this application is disposed of with a direction that

Patna High Court Cr.Misc. No.42384 of 2017 (2) dt.12-09-2017 2/2 once charge sheet has been submitted and he completes four months period in judicial custody, he will be released by the court below itself to its satisfaction, if application for bail is filed on behalf of petitioner.
