The petitioner seeks bail in Manjhi P.S. Case No. 117 of 2017 registered under Sections 414, 420, 379, 467, 468 and 471 of the Indian Penal Code.

On checking of the Bolero Vehicle, three accused persons including the petitioner along with several ATM cards were apprehended by the police.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner happens to be the commuter of the said vehicle and he has no concern with the seized ATM Cards. Similarly situated co-

Patna High Court Cr.Misc. No.46177 of 2017 (2) dt.21-09-2017 2/2 accused, namely, Chhabila Rai and Dhananjay Rai have been enlarged on bail by this court in Cr. Misc. No. 41278 of 2017 dated 07.09.2017 and Cr. Misc. No. 38323 of 2017 dated 21.08.2017 respectively. The petitioner has been languishing in custody since 20.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Chapra in connection with Manjhi P.S. Case No. 117 of 2017.
