JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he having entered into the house of the informant attempted to commit rape on her and when informant protested, petitioner assaulted her by means of sharp cutting weapon.
The contention on behalf of the petitioner is that petitioner is own agnate of informant and as a matter of fact, there was dispute between the parties regarding partition of ancestral lands as a result thereof, the present case has been lodged by the informant at the instigation of her husband and so far as criminal antecedent of the petitioner is concerned, the same was also lodged on account of village politics. Moreover, the informant of
Patna High Court Cr.Misc. No.34145 of 2015 (2) dt.28-08-2015 2/2 the present case has already compromised this case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 08 of 2015.
