This is an application for bail in connection with Dandari P.S. Case No. 38 of 2017 registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of firing but the same did not hit anyone and main allegation is against one Chandan Kumar.

Submission of learned counsel for the petitioner is that FIR shows that he has fired but did not hit anyone and he is in custody since 13.7.2017 and charge sheet has been submitted against him.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail on the ground that petitioner has criminal antecedents.

Having heard both sides and in view of facts and circumstances and also considering the fact that though he is made

No.46647 of 2017 (2) dt.21-09-2017 2/2 accused in two other cases but he is on bail in those cases and now charge has been submitted in this case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Dandari P.S. Case No. 38 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
