The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

The allegation against the petitioner and others is to have killed the deceased and caused to disappear her dead body.

It is submitted that petitioner has been falsely implicated in this case. The informant has been examined in Sessions Trial no. 544 of 2003 as P.W.3 in which in the cross-examination he has stated that all the sons of Sumitra Devi live separately and his daughter told him that if her husband would go to Delhi, she would also go to Delhi. But some altercation took place between them and due to that she committed suicide. Co-accused Sumitra Devi, mother of the petitioner, was put on trial in Sessions Trial no. 544 of 2003 and she has been acquitted. The petitioner is in custody since

Learned counsel for the State submits that the petitioner was absconding and his attendance could be procured by the court on 28.9.2014 after his arrest by the police.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger, in Tarapur P.S. Case No. 36 of 2002 after framing of charge with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence on two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
