Petitioner seeks bail in a case registered under Sections-420, 467, 468, 471/34 of the Indian Penal Code. The allegation against the petitioner is that he alongwith his wife duped the informant as well as her sister-in-law by assuring them to provide government job and accordingly, the petitioner and his wife took more than Rs. 4,00,000/- (four lacs) from the informant as well as her sister-in-law. Patna High Court Cr.Misc. No.40359 of 2016 (3) dt.22-11-2016 2/2 petitioner was himself cheated by one Nirmala Devi. The aforesaid Nirmala Devi took handsome amount from the wife of the petitioner in the name of providing government job to her and moreover, the aforesaid fact has been admitted by the informant herself, which is evident from perusal of paragraph-37 of the case diary. It is further submitted that apart from the informant, some other witnesses also stated that the above-said Nirmala Devi played an important role in the present occurrence. Petitioner is languishing in jail custody since 16-06-2016 and does not have any criminal antecedent. The investigation against the petitioner has already been completed.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patori P.S. Case No. 242 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Samastipur. (Hemant Kumar Srivastava, J) A.K.V./- U T
