JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2017 The petitioner seeks regular bail in connection with Chakai P.S.Case No.68/17 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 240 ltrs. of spicy liquor from the vehicle of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner is driver and not owner of the articles. The petitioner is now in custody for about two months and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with

Patna High Court Cr.Misc. No.41838 of 2017 (2) dt.11-09-2017 2/2 direction to the learned court below that once the charges are framed against the petitioner or he completes three months' period of judicial custody, whichever is earlier, the petitioner, above named, shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 3rd, Jamui in connection with Chakai P.S.Case No.68 of 2017.
