The petitioner is languishing in custody since 26.06.2014 in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. It is alleged that the informant along with her daughter Sohita Kumari went to visit fair at Nawada Bazar from her daughter went missing on 13.10.2013. Her dead body was recovered on 16.10.2013 when the FIR was lodged against unknown. The informant in her subsequent statement alleged that she took Rs.3,000/- as loan from the petitioner and for non-return of the same threatening was given by this petitioner. Patna High Court Cr.Misc. No.41007 of 2014 (03) dt.23-01-2015 2/2 petitioner that only suspicion has been raised subsequently. Though, the petitioner was known to the informant from before, hence, there was no occasion for the informant not to name him in the First Information Report as suspect.

Considering the suspicious nature of accusation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 239 of 2013.
