JUSTICE SANJAY PRIYA ORAL ORDER 3/ 23-08-2017 Heard learned counsel for the Petitioner and the learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in Bairiya P.S. Case No.101 of 2017 instituted for the offence under Section(s) 302, 201, 120-B Indian Penal Code.
Petitioner is not named in the First Information Report. Name of the petitioner has come in the confessional statement of Manturiya Devi as appear from the impugned order. In the written report, it is alleged that husband of the informant had received call on his mobile and thereafter he went out of the house towards north followed by two named accused persons, namely, Ravi Chaudhary and Sudama Chaudhary. Later on, mobile of the husband of the informant was found to be
Patna High Court Cr.Misc. No.37411 of 2017 (3) dt.23-08-2017 2/2 switched off. The informant got information on 21.04.2017 that dead body of her husband is lying between two buildings of New Panchayat Sarkar Bhawan.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Bettiah, West Champaran, in connection with Bairiya P.S. Case No.101 of 2017, subject to the condition that both the bailors shall be close relatives of the petitioner. (Sanjay Priya, J) JA/- U T
