2. In this case, the petitioner is seeking regular bail in connection with Medni Chauki P.S. Case No. 103 of 2024, registered for the offences punishable under Sections 376, 511, 354(B), 341, 323, 354(D), 506 of the IPC.

3. As per allegation, the petitioner attempted to commit rape with the victim. He also assaulted the persons who were attempted to rescue the victim.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. He has submitted further that the petitioner is brother-in-law (devar) of the informant. As a matter of fact, there is some dispute between

Patna High Court CR. MISC. No.59117 of 2024(2) dt.27-08-2024 2/2 husband of the victim and the petitioner for partition of the properties. It has further been stated that when the informant came to know the real fact, he has compromised the case. The petitioner is under custody since 09.05.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Lakhisarai in connection with Medni Chauki P.S. Case No. 103 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) The petitioner shall remain present physically on each and every date before the court below till framing of the charges. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
