The petitioner seeks bail in a case instituted for the offences under Sections 387 of the Indian Penal Code. The Headmaster of the School has lodged an FIR making an allegation that he has received a telephonic call vide mobile no. 85288663256 and demanded extortion money otherwise he will be kidnapped. The police has traced the aforesaid mobile and found that aforesaid mobile belongs to one Birbal Yadav who happens to be the brother-in-law of the petitioner. Birbal Yadav has stated before the police that number of the Headmaster was given by the present petitioner and he has also given an information that Headmaster is a wealthy person and he would be able to give Rs.5,00,000/. Petitioner is in jail since 22.3.2016.

Patna High Court Cr.Misc. No.39265 of 2016 (3) dt.21-10-2016 Having considered the facts and circumstances of the case, let petitioner, Ramesh Yadav, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the IVth Additional Chief Judicial Magistrate Bettiah (West Champaran) in Tr. No.2404 of 2016, arising out of Bairiya P.S. Case No.61 of 2016, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e.

father, mother, wife or son (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail (iii) Pettiioner shall mark his presence before the nearest police station by 7th of every month till six months and (iv) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
