The petitioner apprehends his arrest in Mashrakh P.S. Case No. 222 of 2012, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code. The informant alleged that the petitioner and Dipak Sah took Rs. 20,000/- from the informant on the pretext for providing her job in Aanganbari. It is also alleged that the petitioner had taken photographs and her thumb impression on plain paper and thereafter the petitioner withdrew Rs. 35,000/- from the account of the informant which was meant for Indira Awas. Learned counsel for the petitioner submits that all the allegations are false and concocted. There is no evidence to show that the petitioner withdrew any amount from the account of the informant. The petitioner has filed enquiry report of the Block
Patna High Court Cr.Misc. No.40359 of 2014 (3) dt.13-05-2015 2/2 Development Officer with regard to illegal withdrawal from the account of the informant and the petitioner brought this enquiry report by filing supplementary affidavit. The enquiry report shows that the allegation of the informant is palpably false. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chapra in connection with Mashrakh P.S. Case No. 222 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
