The petitioner apprehends his arrest in connection with Khizarsarai P.S. Case No. 308 of 2018, registered under Sections 366A, 504 and 506/34 of the Indian Penal Code. The accusation is of kidnapping of Neha Kumari, aged about 17 years, daughter of the informant by Niraj Kumar (petitioner) and Anand Mohan for the purpose to perform the marriage.
Learned counsel for the petitioner submits that, in fact, due to love affairs daughter of the informant left her parental house and proceeded to Mumbai and performed the marriage with the petitioner according to her own sweet will,
Patna High Court CR. MISC. No.59316 of 2019(2) dt.20-09-2019 2/2 which would from her statement recorded under Section 164 of the Cr.P.C. (Annexure 2 to the petition). Moreover, in her medical examination, her age has been assessed as 19 years. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Khizarsarai P.S. Case No. 308 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
