The petitioner seeks bail in connection with Pandarak P.S.Case no. 69 of 2015 (S.Tr. No. 751 of 2015) registered under Sections 489(d), 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code, pending in the court of learned Additional District Judge-1,Barh, Patna.

Earlier the prayer for bail of the petitioner was rejected vide Cr. Misc. No. 38507 of 2015 dated 01.11.2015 with a direction to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of that order. This is the second attempt on behalf of the petitioner. A report was

Patna High Court Cr.Misc. No.43416 of 2016 (3) dt.23-11-2016 2/2 called for from the court below. It has been reported that the charges have been framed and within a period of six months the trial is expected to be concluded.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioner and same is rejected.

The trial court is directed to take all steps to conclude the trial within six months from the date of receipt/production of a copy of this order.

The District Magistrate, Patna and Senior Superintendent of Police, Patna are directed to ensure that the prosecution witnesses are produced on the date fixed by the trial court, so that the trial may be concluded within the stipulated period.

Let a copy of this order be communicated to District Magistrate, Patna and Senior Superintendent of Police, Patna, for necessary action.
