JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bodhgaya P. S. case no. 467/2018 registered under sections 272, 273 of the IPC and sections 30(a), 30(d) of the Bihar Prohibition & Excise Act.

According to the prosecution case itself, 20 kg rotten Kismis were recovered from the house of the petitioner and except the aforesaid rotten kismis nothing was recovered from the house of the petitioner. The petitioner does not have any criminal antecedent. Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this

No.57292 of 2018 (2) dt.20-09-2018 order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Gaya in Bodhgaya P. S. case no. 467/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
