JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 12.09.2018 passed in Criminal Miscellaneous No.45909 of 2018 and again vide order dated 31.01.2019 passed in Criminal Miscellaneous No.3057 of 2019 and allegation against the petitioner is that with the help of other accused persons the petitioner has thrown the dead-body of the deceased in a field.

Submission of learned counsel for the petitioner is that as such above allegation there is nothing against the petitioner. Two witnesses have already been examined, including the informant and they have not supported the prosecution case and thereafter, no other witnesses have been examined. Petitioner is in custody since 01.03.2018.

In view of the facts as stated above, let the petitioner above named be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Samastipur, in connection with Mohinuddin Nagar P.S. Case No.18 of 2018, subject to condition that petitioner will co-operate in disposal of the trial and make himself available as and when required by the court below, failing which his bail bonds shall be cancelled.
