JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Ghosi P. S. Case No. 310 of 2003 registered under Sections 467, 468, 471 and 420/34 of the Indian Penal Code.

Regard being had to the nature of the offence and the fact that charges have already been framed and the trial is going on, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad in Ghosi P. S. Case No. 310 of 2003 subject to following conditions:-

No.39875 of 2016 (2) dt.20-09-2016 2/2 (a) One of the sureties must be the son of the petitioner, namely, Raj Kumar Kamal, who has sworn affidavit in the present case and other one should also be a Government servant/elected people's representative of Panchayat/ Municipality.

(b) The petitioner must file an undertaking before the court that he shall appear in person on each and every date during trial unless exempted by the court on any valid ground.

(c) Failure to attend the proceedings of the court on three consecutive dates shall automatically entail in cancellation of bail bond of the petitioner.
