Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with N.D.P.S. Case No. (SL. No-38/22) arising out of Buxar Rail P.S. Case No. 109 of 2022 lodged under Sections 8(C) ,20, 21(C), 22(VI), 20/22 of the N.D.P.S. Act read with Sections 420/34 of the I.P.C.

As per the prosecution case, the recovery of total 466 bottle each 100 ML cough syrup from petitioner no.1 and 139 bottle each 100 ML cough syrup was alleged to be made from

Patna High Court CR. MISC. No.59613 of 2022(3) dt.24-02-2023 2/2 petitioner no.2 in this case.

Learned counsel for the petitioners submits that in gram, it shall be 4.66 gram from the possession of the petitioner no.1 and 1.39 gram from the possession of the petitioner no.2. Counsel further submits that antecedent of the petitioners are clean and they are in custody since 16.07.2022. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur at Arra in connection with N.D.P.S. Case No. (SL. No-38/22) arising out of Buxar Rail P.S. Case No. 109 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
