JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,379 and 504/34 of the Indian Penal Code.
The prosecution case as alleged by the informant Sunita Devi is that she was married with co accused Biran Choudhary in 2010 and subsequently got pregnant. Her husband and other inlaws started inflicting torture, as a result, the informant filed maintenance case before the learned Principal Judge, Family Court, West Champaran wherein Rs.5000/- as ad-interim maintenance per month was awarded. Since the accused persons gave life threatening to the informant, she went to the police
Patna High Court Cr.Misc. No.37570 of 2015 (2) dt.17-09-2015 2/2 station to inform the police and while returning, she was being assaulted by the petitioner and others. The petitioner is the second wife of the husband of the informant.
It is submitted by the learned counsel for the petitioner that the informant has also lodged a case under section 498A IPC against her husband.
Considering the background in which the accusation has been levelled, the petitioner being a lady and other accused persons have been granted anticipatory bail vide Cr. Misc. No. 5058 of 2015, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran at Bettiah in connection with Srinagar Pujaha P.S. Case No.31 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
