JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 366 and 366(A)/34 of the Indian Penal Code. The statement of the victim has been recorded under Section 164 of the Cr.P.C. in which she stated that she left her home by her own sweet will and called the petitioner and thereafter, solemnized her marriage with the petitioner. The victim disclosed her age as 19 years. The Medical Board also found her age between 18-19 years but the learned Additional Sessions Judge, only on technical ground, rejected the bail petition of the petitioner.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.40377 of 2016 (2) dt.28-09-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Purnea in connection with Rupauli P.S. Case No.137 of 2016.
