ANJANA PRAKASH ORAL ORDER 29-07-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in S.T. No.126 of 2015 arising out of Kusheshawar Asthan P.S. case No.16 of 2013 instituted for the offence under Sections 302/34 of the Indian Penal Code, pending in the court of 1st Additional Sessions Judge, Benipur, District Darbhanga.
Counsel for the Petitioner submits that only nine out of twenty one witnesses have been examined as yet, whereas the Counsel for the Informant submits that the trial is going on day-today basis. The Counsel for the Informant undertakes to produce the witnesses on each date as required by the Trial Court. Be that as it may, in view of the nature of allegations, I am not inclined to review the earlier order refusing bail to the
Patna High Court Cr.Misc. No.32247 of 2015 (2) dt.29-07-2015 2/2 petitioner.
Prayer for bail is once again rejected.
The Trial Court is directed to proceed in the manner as it deems fit for concluding the trial expeditiously, for which reason he shall send a list of the witnesses fixing specific dates for each witness for their examination along with a copy of this order to the S.P., Darbhanga, who is directed to ensure the attendance of the witnesses on the date fixed by the Trial Court so that there is no further delay in the trial.
