The petitioner apprehends his arrest in Lalganj P.S. Case No.77 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from possession of the petitioner. The alleged recovery has been made from the bhatthi of co-accused Kailash Sahni. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a

No.67481 of 2021(2) dt.29-04-2022 2/2 copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge, Excise Court, Vaishali in connection with Lalganj P.S. Case No.77 of 2021 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
