JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 379, 380, 307, 448, 427 and 436 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the FIR named persons and others came to the house of the informant, robbed the jwellery and other articles and set the house of Chhatish Mahto on fire. It is submitted by learned counsel for the petitioners that the accusation is not specific against the petitioners when Chhatish Mahto has not deposed that his house has been set on fire, nor during investigation, investigating agency found any burnt house and considering the above facts, co-accused Uma Yadav has been granted anticipatory bail vide Cr. Misc. No. 7725 of 2014. The

Patna High Court Cr.Misc. No.1180 of 2015 (2) dt.13-01-2015 2/2 order of the same has been brought on record as Annexure-2. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar, in connection with Kursela P.S. Case No. 103 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
