The petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The petitioner along with other accused persons is alleged to have assaulted Sunita Devi, the mother of the informant. Patashu Dom and Kaushal Ram, the petitioner who were armed with country made pistol made indiscriminate firing on the father of the informant and father of the informant died. It is submitted that the deceased got one firearm injury and three persons are alleged to have fired. Similarly situated accused Patashu Dom who is also alleged to have fired have already been enlarged on bail vide orders passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.32384 of 2015 (2) dt.19-08-2015 2/2 13376 of 2015 and the case of the petitioner stands on same footing.
Learned APP, however opposed the prayer for bail and submitted that the deceased got three injuries. Of course, out of three injuries two injuries are abrasions not caused by firearm and only one firearm injury was found on the dead body of the deceased.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kadamkuan P.S.
