JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in connection with a case registered under Sections 147, 148, 149, 323, 324, 379 and 504 of the Indian Penal Code.
Allegation in brief is that one of the accused was outraging the modesty of the informant's sister the informant protested thereafter other accused also turned up and Deepu Sah is said to have assaulted with farsa but did not hit the informant. Thereafter, others also participated in the occurrence. Learned counsel for the petitioners submits that it is a
Patna High Court Cr.Misc. No.37678 of 2017 (2) dt.10-08-2017 2/2 case and counter case between both sides. The F.I.R. was lodged by Shyam Sundar Sah while he was under treatment in the hospital and exaggerated version is made by the informant. Injuries found on the person of the informant's sister are only swelling in the right eye and these petitioners have no criminal antecedent and both sides are neighbours.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Deepu Sah, Bhuti Sah, Dharmendra Sah, Shyam Sunder Sah, Sunita Kumari, Ramsawari Devi @ Sawariya Devi and Banarasi Sah, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-IVth, Bettiah, West Champaran in connection with Bairiya P.S. Case No.92 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
