JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Khagaria (Gangour) P.S. Case No. 417 of 2018 registered for the offences punishable under Sections 498-A, 495 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Petitioners happen to be in-laws of the informant, whose marriage was solemnized with co-accused, Jai Shankar Poddar in the year 2011 and after marriage, she gave birth to two children out of the aforesaid wedlock.

Patna High Court Cr.Misc. No.57245 of 2018 (2) dt.20-09-2018 2/2 Although, there is allegation against these petitioners that they used to torture the informant on account of non fulfilment of illegal demand but it appears that the aforesaid allegation is general and omnibus in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Khagaria (Gangour) P.S. Case No. 417 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
