2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 126 ( 2 ), 115 ( 2 ), 118 (1) , 303 ( 2 ), 109, 352 and 351 ( 2 ) of the BNS.
3 . As per F.I.R., on the alleged date and time of occurrence , petitioner No. 1 assaulted informant with knife and petitioner No. 2 snatched gold chain from neck of informant.
4. It is submitted on behalf of the petitioners that both
Patna High Court CR. MISC. No.54863 of 2025(2) dt.27-08-2025 2/2 petitioners are innocent and has committed no offence as alleged. The present case is counter blast of Muffasil PS Case No. 243 of 2025 which was lodged by one Shoba devi wife of petitioner No. 1 against informant and others. Doctor has found the injury simple in nature . Rest of the allegations are ornamental in nature in order to make the case grave in nature . Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the nature of injury , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate East Champaran Motihari in connection with Muffasil P.S. Case No. 242 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
