The petitioner seeks bail in Sessions Trial No.86/17 arising out Dhanaha P.S. Case No.104/16 for the offence under Sections 304(B) and 201/34 of the I.P.C.
Earlier prayer for bail of the petitioner has already been rejected vide order dated 13.01.2017 passed in Cr.Misc. No.53856/16 on merit.
Submission of the learned counsel for the petitioner is that he is in custody for more than a year. Only three witnesses have yet been examined in this case and there is no likelihood of conclusion of trial in near future Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.38033 of 2017 (2) dt.23-08-2017 2/2 Having heard both sides and in view of the fact that earlier prayer for bail of the petitioner has already been rejected, I am not inclined to grant bail to the petitioner and again his prayer for bail is rejected.
However, trial court is directed to expedite the trial and conclude preferably within six months from production of a copy of this order. If the trial is not concluded within the aforesaid period, petitioner may renew his prayer for bail. (Vinod Kumar Sinha, J) AnilKrSinha/- U
