The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code and Sections 3⁄4 of the Explosive Substance Act.
Allegation is that 25-30 unknown miscreants entered into the house of the informant and looted away house hold articles worth Rs.4,68,000/-.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.03.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional
Patna High Court CR. MISC. No.51815 of 2019(2) dt.20-08-2019 2/2 statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. West, Muzaffarpur in connection with Kanti P.S. case No.682 of 2018 (Trial No.3918 of 2019).
