The petitioners seek bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The son of the deceased Mukesh Singh has stated that when he and his father were going to catch the bus on the order of Ashok Singh, Yogendra Singh fired which hit on the waist of Mahesh Singh, the father of the informant. The informant further alleged that Ranvir Singh, Rahul Singh, Birendra Singh, the petitioners were also standing there, but no overt act is alleged against the three petitioners. Gajendra Singh is alleged to have indiscriminately fired but nobody was injured.

Patna High Court Cr.Misc. No.32743 of 2015 (2) dt.20-08-2015 2/2 Learned counsel for the informant submits that during the course of investigation, the witnesses have stated that the petitioners also fired and the petitioners have got criminal antecedent.

From perusal of the FIR itself, appears that no overt act is alleged against the petitioners, even the witnesses disclosed that the petitioners also made firing, but nobody was injured in the firing made by the petitioners.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Islampur P.S. Case No. 94 of 2015.
