The petitioner seeks bail in Sanjhauli P.S. Case No. 85 of 2016 registered under Sections 2, 20(b) (ii) (B) of the N.D.P.S. Act.

As per the prosecution case, 16.240 gram of ganja is said to have been recovered from the house of the petitioner and her husband.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from her conscious physical possession rather from the house of her husband where the petitioner is living with her husband, who is also in custody. Moreover the said house is inhabited by the joint family members. The petitioner is a lady and has been languishing in custody since 18.05.2017.

Patna High Court Cr.Misc. No.38237 of 2017 (02) dt.16-08-2017 -2Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Rohtas, Sasaram in connection with Sanjhauli P.S. Case No.85 of 2016.
