The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 120B of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received about the petitioner and others have been involved in the trade of liquor, it is stated that a raid was conducted and 1100 litres of liquor was recovered from the land not belonging to this petitioner.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in the case. He has no concern either with the seized liquor nor with the land from which the same was recovered. The petitioner is in custody

Patna High Court CR. MISC. No.66491 of 2021(2) dt.23-02-2022 2/2 since 18.6.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 8 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Kanti P.S. Case no.68 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
