Petitioner is accused in connection with Pupri P.S. Case No. 136 of 2016 registered under Sections 399, 402, 414 of the I.P.C., 25(1-b)A, 26, 35 of the Arms Act and 3⁄4 of Explosive Substance Act and 47(A) of the Bihar Excise Act. The accusation is of recovery of one cartridge from his possession.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and nothing has been recovered from his possession, except one cartridge. Further submission is that petitioner has no criminal antecedent and one co-accused namely, Heera Sahni @ Netaji, from whose possession one

Patna High Court Cr.Misc. No.49491 of 2016 (3) dt.18-01-2017 2/2 country-made pistol was recovered, has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 48823 of 2016. Petitioner is in custody since 08.07.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Pupri at Sitamarhi in connection with Pupri P.S. Case No. 136 of 2016.
