The petitioner is in custody in connection with Lakhnaur P.S. Case No. 255 of 2020 registered for the offence under Sections 363, 366(A)/34 of Indian Penal Code. This is a case in which cognizance has been taken under Sections 363, 366(A), 376 read with Section 34 of Indian Penal Code and Section 4 of the POCSO Act against the accused persons including the petitioner. The minor victim has supported the allegations against the petitioner of kidnapping and sexual assault upon her.

Learned counsel for the petitioner submits that trial has begun and the minor victim and the mother of the minor victim have been examined and they have not supported the prosecution story.

Patna High Court CR. MISC. No.55380 of 2022(2) dt.23-12-2022 2/2 In view of the fact that this is a case of kidnapping and sexual assault upon the minor victim and trial is already in process, I am not inclined to grant bail to the petitioner. This application is dismissed.
