2. In this case, the petitioner is seeking regular bail in connection with Harsidhi P.S. Case No. 325 of 2024, registered for the offences punishable under Sections 414, 399, 402 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act.

3. As per allegation, in course of vehicle checking by the informant, one Scarpio car tried to flee away but apprehended. Five persons have been arrested form the said car and on search from the petitioner, one loaded country made pistol with a cartridge has been recovered.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.59164 of 2024(2) dt.28-08-2024 2/2 petitioner is innocent and has falsely been implicated. He is a person of clean antecedent and is under custody since 11.06.2024 for false allegation of recovery of country made pistol and three live cartridges.

5. On the other hand, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, especially the clean antecedent of the petitioner, the petitioner, above-named, is directed to be released the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st, Class, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 325 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
