Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition of Excise Amendment Act 2022.

The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and allegation is of recovery of 84 liters of liquor from two motorcycles. 4.

It is next submitted that petitioner was not arrested from the spot and later during the course of investigation, he was arrested based on the fact that he is owner of one of the seized motorcycles. It is further submitted that no prudent person would use his own vehicle for committing an occurrence and thus would create evidence against himself and hence

Patna High Court CR. MISC. No.60540 of 2024(2) dt.31-08-2024 2/2 would get implicated. It is next submitted that petitioner is in custody since 10.07.2024.

The learned APP for the State opposes the regular bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge of Excise-1, Aurangabad in connection with G.R. No. 238 of 2024 corresponding to Deo P.S. Case No. 101 of 2024 subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
