Earlier vide order dated 18.10.2017 in Cr. Misc. No. 44875 of 2017 the prayer for bail of the petitioner was rejected with observation that once such D.N.A. report has been filed, the petitioner is at liberty to move before the learned Court below. Submission of the learned counsel for the petitioner is that the D.N.A. report has been made available and thereafter, he moved before this Court but his prayer for bail was earlier rejected.

It appears from the order of the learned Trial Court that F.S.L. report had not been made available. As such the

Patna High Court Cr.Misc. No.44875 of 2017 (4) dt.22-11-2017 2/2 petitioner shall move before the learned Trial Court once D.N.A. report is made available and after considering the same, the learned Trial Court shall dispose of the prayer for bail. (Vinod Kumar Sinha, J) Sudha/- U T
