2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 272, 273 308 , 328 , 414, 467 and 468 , 471 of the IPC and section 30 (a) of the Bihar Prohibition and Excise Act and 20 ( b ) ( ii ) (c), 23 (c) and 29 of the N D P S Act.
3 . Prosecution case , in brief, is that is that 1 kg of Charas like substance was recovered from the tool box of the seized car and 155 litres of spirit, a plastic bucket and a oil flask have been recovered from the dicky of the seized car and 60,000 liters of spirit found in both the tankers and dicky of the seized car.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.54152 of 2025(2) dt.19-09-2025 2/2 petitioner is neither owner nor driver of the seized vehicles from which recovery has been made . No incriminating material has been recovered from the conscious possession of this petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 13.05.2025 . Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive special Excise Court No. 1 Civil Court East Champaran at Motihari in connection with Piprakothi P.S.
