Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 304 (B)/34 of the Indian Penal Code.

The allegation is that due to non fulfillment of demand of dowry, the accused including the petitioner tortured the sister of the informant, causing death of the deceased. During investigation, police has submitted charge sheet under Section 306 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that it is a case of suicide and the petitioner has no criminal antecedent. There is no chance of tampering the evidence. Considering the facts and circumstances, petitioner Arun Sah @ Arun Kumar Sah shall be released on bail on furnishing

Patna High Court Cr.Misc. No.40369 of 2014 (3) dt.09-02-2015 2/2 bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai / court concerned in connection with Cheriya Bariyarpur P. S. Case No. 159/2013 after framing of charge with following conditions:- I) One of the bailors will be the close relative of the petitioner.

II) The petitioner will not indulge in similar or in any other offence.

III) The petitioner will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
