JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. The name of petitioner came in confessional statement of co-accused and after that the looted motorcycle is said to have been recovered from the house of the petitioner. Submission on behalf of the petitioner is that the said recovery was made from the house of Bansu Bind, who happens to be father of the petitioner. It is further submitted that so far as petitioner is concerned, he does not have any criminal antecedent and is languishing in jail custody since long whereas father of the petitioner has already been granted privilege of bail by the learned

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Chenari P.S.
