JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The accusation against petitioner is that he assaulted the deceased by means of Lathi but postmortem report reveals that no external injury was found by the doctor though the doctor opined the cause of death as shock and haemorrhage due to injuries, mentioned in the postmortem report. Moreover, after investigation, police submitted charge sheet for the offence punishable under Section-304 of the Indian Penal Code.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
