Petitioner carried criminal antecedent and he was arrested in connection with Shyampur Bhatanha P.S. case no. 82/2014 in which he made his confessional statement disclosing involvement in the present case and accordingly, petitioner was remanded in this case on 23.5.2015 and since then he is languishing in jail custody. Admittedly, nothing has been recovered from conscious possession of the petitioner nor petitioner has been put on test identification parade.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in Rajepur P.S. Case no. 52/2014.
