JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-12-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bhagwanpur Hat P.S. Case No.103 of 2020, registered for the offence punishable under Sections 394 and 411 of the Indian Penal Code and Section 25(10-b)a, 26 and 27 of the Arms Act. Petitioner is in custody since 19.05.2020. His prayer for regular bail was earlier rejected by an order dated 06.01.2021 passed in Cr. Misc. No. 32264 of 2020 with a liberty to the petitioner to renew his prayer for bail after six months, if there was no substantial progress at the trial. Accordingly, this application has been made renewing the prayer for regular bail. Learned counsel appearing on behalf of the petitioner has drawn my attention to the order sheet of the trial arising out of said Bhagwanpur Hat P.S. Case No.103 of 2020

Patna High Court CR. MISC. No. 66235 of 2021(3) dt.08-12-2021 2/2 and has submitted that there has not been any substantial progress at the trial at all.

On perusal of the order sheet, I find substance in the submission made on behalf of the petitioner. Considering the facts and circumstances, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-I, Siwan, in Bhagwanpur Hat P.S. Case No.103 of 2020.
