The petitioners seek anticipatory bail in a case instituted for the offences under Sections 363, 366A and 34 of the Indian Penal Code.

Petitioners are family members of Radhey Shyam Kumar. Allegation has been made that that they have kidnapped the victim girl for the purposes of marriage. The statement made by victim girl shows that they were in love and she out of her own had gone there and entered into marriage. Looking to the facts and circumstances of the case, in the

No.58286 of 2018 (3) dt.01-10-2018 2 /2 event of arrest or surrender within four weeks from today, let petitioners, namely, Shyam Kumar, Brajesh Kumar, Babita Devi, Yashoda Devi and Ekarasi Devi, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No.178 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
