The petitioner seeks bail in a case registered under Sections 363, 366, 498, 379 of the Indian Penal Code. Allegation is that the petitioner kidnapped the daughter of the informant with intention to illicit work or to solemnize marriage.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim has been examined under Section 164 of Cr.P.C. She has not supported the allegations made in the F.I.R. She had left the house out of her own will.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri D.K. Pandey, J.M. 1st class, Kishanganj in connection with Kodhobari P.S. case No.39 of 2019.
