Petitioner happens to be the husband of the deceased. The deceased died in suspicious condition at her matrimonial home. The marriage of the petitioner had taken place with the deceased eight years ago. In course of investigation, two theories came in light. The first is said that deceased was unable to produce offspring and the petitioner wanted to desert her and that was the reason she was killed. The second theory of death of the deceased came that maternal uncle of the petitioner wanted to purchase his land which was opposed by the deceased and on account of that petitioner and other accused committed murder but no mark of injury was found on person of the deceased in course

Patna High Court Cr.Misc. No.26172 of 2016 (5) dt.18-10-2016 2/2 of postmortem examination. However, after conclusion of the investigation, I.O. submitted chargesheet for the offence punishable under Section 306 of the IPC.

Considering the aforesaid facts and circumstances as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-II, Saran, Chapra in connection with Marhowrah P.S.Case No.384 of 2015.
