Informant is not an eye-witness of the alleged occurrence and in course of investigation, not a single prosecution witness claimed to have seen actual killing of the deceased. Informant raised suspicion against the petitioner and some others.
Admittedly, some co-accused persons have already been granted privilege of bail by different benches of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Murar P.S. Case no. 40/2012.
